Trademark Examiners from Latin America are trained in 3D Trademarks under the EUIPO Umbrella

n an effort to promote cooperation and harmonisation in the field of intellectual property, Trademark examiners from MERCOSUR and Chile met to participate in specialised training on three-dimensional trademarks.

The event, "Training on Trademark Examination Practice: 3D Trademarks," was conducted online and was attended by The event was attended by leading representatives of the Intellectual Property offices of Chile, Argentina, Brazil, Uruguay and Paraguay.

This workshop focused on the law and examination practices of the European Union Intellectual Property Office (EUIPO) in relation to three-dimensional markings. The main objective of the event was to provide the examiners with a comprehensive understanding of the processes and criteria involved in the examination of three-dimensional marks by the EUIPO and encourage a consistent approach to examination practices.

Workshop participants had the opportunity to learn key skills, including:

  • Understanding the legal framework: explored the legal framework governing three-dimensional marks in the European Union, providing examiners with an in-depth overview of the relevant regulations.
  • Examination criteriaThe EUIPO's criteria for examining three-dimensional trade mark applications were addressed, enabling participants to assess applications in an effective manner.
  • Identifying challengesThe following discussion was held: common challenges that examiners may encounter during the process of examining three-dimensional marks were discussed.
  • Best practices and strategiesThe workshop presented best practices and strategies that can be applied in the examination of three-dimensional marks, promoting a consistent and efficient approach.
  • Relationship with other Intellectual Property Rights: explored the relationship between 3D trademarks and other intellectual property rights, including designs, copyrights and patents.

This event was a unique opportunity for brand examiners in the region, as it allowed them to gain valuable knowledge and make connections with other experts. Collaboration and harmonisation of examination practices are essential in the field of intellectual property, and this workshop contributed significantly to this objective.
