Jurisprudence Conference for the CARIFORUM region, MERCOSUR and Chile

The Jurisprudence Conference for the CARIFORUM region, MERCOSUR and Chile is organised by the CARIFORUM Intellectual Property Rights and Innovation Project (CarIPI), together with the Caribbean Court of Justice Academy of Law (CCJ) and the Intellectual Property Office of Jamaica. This initiative is part of the AL-INVEST Verde IPR programme, which aims to compile a comprehensive body of case law on trademark law.

The main objective of this collaborative effort is to improve understanding of the legal and regulatory frameworks governing intellectual property (IP) as well as the judicial treatment of disputes throughout the CARIFORUM region, MERCOSUR nations and Chile. In addition, the conference aims to facilitate the dissemination and exchange of information on judicial decisions in IP-related matters.

CarIPI representatives will include judges from Caribbean nations and IP legal experts based in Jamaica. The all-female AL-INVEST Verde IPR team of experts consists of judges from Argentina, Brazil, Chile, Paraguay and Uruguay. Together, they will delve into issues such as the safeguarding of well-known trademarks, the imperative of trademark use, online infringement issues, legal actions for infringement and other relevant aspects.

The conference programme includes presentations on the evolution of IP adjudication in English-speaking jurisdictions, as well as compilations of existing case law. It will also include analyses of case law in non-English speaking regions and emerging trends, along with presentations from each jurisdiction focusing on patents, industrial designs, trade marks, appellations of origin and copyright.

A specialist recruited by AL-INVEST Verde DPI will oversee the compilation of the compendium of trademark jurisprudence, for which a network of judges will be established. Throughout the conference, judges from MERCOSUR countries and Chile will submit recent and significant national judgments and court decisions on trademark law for inclusion in the compendium.

Throughout the two-day event, discussions will focus on the legislative impact on judicial decisions and the transnational ramifications of IP adjudication between CARICOM, CARIFORUM and Europe. Finally, collaborative activities will be organised to compare case law between CARIFORUM jurisdictions and identify best practices.
