A major milestone: publication of the first national guidelines for the examination of trademarks in Paraguay

Component 3 for Intellectual Property Rights, implemented by the EU Intellectual Property Office (EUIPO), recognises and congratulates the National Directorate of Intellectual Property of Paraguay (DINAPI) for the presentation of its first national guidelines for the examination of trademarks. This development is a decisive step towards improving the accessibility, consistency and predictability of trademark registration procedures in the country.

The creation of these guidelines was possible thanks to the technical support given by the EUIPO through AL-INVEST Verde IPR, aimed at promoting international best practices in intellectual property and strengthening institutional capacities. The support provided allowed DINAPI to develop the document based on Paraguayan legislation, as well as international references, including the EUIPO's own guidelines for the examination of European Union trademarks.

The main objective of this work was to strengthen transparency and legal certainty in examination practices, benefiting both right holders and legal practitioners in Paraguay and abroad. By establishing clear and consistent criteria, the guidelines facilitate the process for applicants and provide a comprehensive guide that integrates legal principles, administrative decisions and relevant case law.

This milestone represents the second experience with the joint development of national guidelines under Component 3 or AL-INVEST Verde ECD, after the publication of updated Uruguayan trademark examination guidelines in November 2024.
